Child Custody and Visitation

In a case of adoption of a child by same-sex couples, custody and visitation will be handled by the courts in the same manner as a divorcing heterosexual couple with either natural-born or adopted children. In the case of a same-sex couple with children from prior relationships of one or both partners, the court will handle the matter similarly to step-parent rights in a heterosexual dissolution action. A non-biological parent who has provided for and bonded with a child in a familial relationship and can be considered a "psychological parent" may petition for visitation rights in a dissolution matter.
