The New Jersey civil union law was enacted in December of 2006 in order to afford same-sex couples the same basic rights as married heterosexual couples. The civil union statute specifically states that laws that apply to marriage apply to civil unions.

Child Custody and Visitation
In a case of adoption of a child by same-sex couples, custody and visitation will be handled by the courts in the same manner as a divorcing heterosexual couple with either natural-born or adopted children. In the case of a same-sex couple with children from prior relationships of one or both partners, the court will handle the matter similarly to step-parent rights in a heterosexual dissolution action. A non-biological parent who has provided for and bonded with a child in a familial relationship and can be considered a "psychological parent" may petition for visitation rights in a dissolution matter.
